Former HealthSouth Corp. CEO Richard Scrushy is asking a court to release him from federal prison on bond while he awaits a new sentencing for his 2006 conviction in a government corruption case.

Scrushy filed the request recently with a federal judge in Montgomery, Ala.

Scrushy has served almost four years in prison after being convicted in a bribery scheme with former Alabama Gov. Don Siegelman. But a federal appeals court threw out some of the counts earlier this year and ordered a new sentencing hearing.

Siegelman already is free on bond, and now Scrushy wants out of prison, too. A motion says he can go to a halfway house a year from now.

No date is set for a new sentencing, and a court has yet to rule on Scrushy's request.
