ClearCount Responds to Patient Safety Technologies’ Press Announcement of Patent Legal Action

PITTSBURGH--(BUSINESS WIRE)--ClearCount Medical Solutions, a leader in patient safety solutions, today issued the following statement regarding Patient Safety Technologies’ June 13th press release announcing the filing of a legal action alleging ClearCount’s infringement of a single patent. As of this release, ClearCount has not yet seen a copy of the legal action and has yet to receive any notice from Patient Safety Technologies regarding the lawsuit.

“We respect the intellectual property of all companies and have a robust IP portfolio ourselves, including nine issued patents and multiple pending patents covering our SmartSponge System. We are confident that our products do not infringe Patient Safety Technologies’ patent and we intend to vigorously defend ourselves in the suit,” said David Palmer, chief executive officer of ClearCount. “Given the obvious technological superiority of our products, we are surprised by any assertion of patent infringement.”

ClearCount’s Radio Frequency IDentification (RFID) based platform is the only technology available that provides a true closed-loop reconciliation of the sponge count. All equipment and RFID tags are validated before use in each case. During surgery, sponges are individually tracked from the initial check-in through the out count. When called upon, the detection wand assists to quickly locate missing sponges. To date, this counting and detection approach has made retained sponges a true “Never Event” in all operating rooms where ClearCount’s technology has been implemented.
